These Terms of Service ("Terms") govern your access to and use of the Molly Grace Boutique website and your purchase of any products from us. Please read them carefully.
Molly Grace Boutique ("Molly Grace Boutique," "we," "us," or "our") operates as an online-only business. You can reach us at info@mollygraceboutique.com.
PLEASE NOTE: Section 14 contains a binding arbitration provision and a class action waiver that affect your legal rights. Section 15 explains how you may opt out of arbitration within 30 days.
1. Acceptance of These Terms
By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy and Return Policy, each of which is incorporated here by reference.
If you do not agree to these Terms, do not use our website or place an order.
Eligibility. You must be at least 18 years old and able to form a binding contract to purchase from us. By placing an order you represent that you meet these requirements and that all information you provide is accurate.
2. Changes to These Terms
We may update these Terms at any time. Changes take effect when posted, and we will revise the "Last Updated" date above. Material changes will be communicated more prominently. The Terms in effect at the time you place an order govern that order. Your continued use of the website after changes take effect constitutes acceptance.
3. Product Information, Pricing, and Errors
We work to describe our products accurately and to display current prices. However, product descriptions, images, colors, availability, and pricing may occasionally contain errors or inaccuracies.
Colors and appearance. Screen settings vary, and the color of a product as displayed on your device may differ from the physical item.
Pricing errors. If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel or refuse any order placed at that price, whether or not the order has been confirmed and payment taken. If we cancel an order for this reason, we will notify you and issue a full refund promptly.
Availability. All products are offered subject to availability. We may limit quantities, refuse or cancel any order, and discontinue any product at any time.
4. Orders and Payment
An order is an offer to purchase. Our acceptance occurs when we send you a shipping confirmation, not when you receive an order confirmation email or when payment is authorized.
Orders are processed only after payment has been received in full. Available payment methods are displayed at checkout and may vary. You represent that you are authorized to use the payment method you provide.
Total price. The price shown at checkout includes applicable sales tax and, where indicated, import duties. Any additional charges will be disclosed before you complete your purchase.
Fraud and chargebacks. We may cancel orders and refuse service where we reasonably suspect fraud, payment card misuse, or abuse of our policies. Filing a chargeback without first contacting us at info@mollygraceboutique.com does not resolve your issue faster and may delay a refund you are otherwise entitled to.
5. Shipping, Delivery, and Import Duties
Fulfillment origin. Our products are shipped from our supplier located in China.
Processing time. 1–3 business days.
Estimated delivery time. [INSERT CURRENT RANGE] business days after dispatch, depending on destination and customs processing.
Delivery estimates are estimates, not guarantees. Actual delivery may be affected by customs inspection, carrier delays, weather, and peak periods.
Shipping deadline. Consistent with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, if we are unable to ship your order within 30 days of receiving your payment, we will notify you, offer you the choice of consenting to a delay or cancelling for a full refund, and issue a prompt refund if you choose to cancel or do not respond.
Import duties and customs charges. The United States suspended the $800 de minimis duty exemption, and shipments to US customers are now subject to applicable duties and customs entry requirements regardless of value.
We ship on a Delivered Duty Paid basis. Applicable import duties and fees are calculated and collected at checkout, and are included in the total price you pay. You will not be asked to pay additional duties or customs charges to the carrier upon delivery. If you are ever presented with such a charge, contact us at info@mollygraceboutique.com and we will resolve it.
Title and risk of loss. Title and risk of loss pass to you upon delivery to the address you provide.
Address accuracy. You are responsible for providing a complete and correct shipping address. If you need to correct an address, email us at info@mollygraceboutique.com as soon as possible and in any event within 24 hours of placing your order. We will make reasonable efforts to update it, but we cannot change an address after the order has been dispatched.
Delivered packages. Where carrier tracking confirms delivery to the address you provided, we are not responsible for subsequent loss or theft. If tracking shows delivery but you have not received your package, contact us and we will help you open a claim with the carrier.
6. Returns, Exchanges, and Cancellations
Returns, exchanges, and cancellations are governed by our Return Policy, which forms part of these Terms. Please review it before ordering.
7. Promotions, Discounts, and Bundles
Promotional codes, bundle pricing, and sale prices are subject to the terms stated at the time of the offer. They cannot be combined unless expressly stated, may be withdrawn at any time, have no cash value, and may not be applied retroactively to completed orders.
Where a bundle or multi-item discount applies and you return part of the bundle, the discount may be recalculated and your refund adjusted accordingly.
8. Acceptable Use
You agree not to use our website to violate any law, infringe anyone's rights, transmit malicious code, scrape or harvest data by automated means, interfere with the operation or security of the site, place fraudulent orders, or resell our products without our written permission.
We may suspend or terminate your access for any violation of these Terms.
9. Intellectual Property
All content on this website, including text, product descriptions, images, photographs, logos, graphics, page design, and the MollyGrace Boutique name and marks, is owned by us or our licensors and is protected by United States and international intellectual property laws.
You may view and print content for your own personal, non-commercial use. Any other use, reproduction, modification, distribution, or public display without our prior written permission is prohibited.
Copyright complaints. If you believe content on our site infringes your copyright, send a notice complying with the Digital Millennium Copyright Act to info@mollygraceboutique.com.
10. Third-Party Links
Our website may link to third-party websites and services. We do not control and are not responsible for their content, products, or practices. Your dealings with third parties are solely between you and them.
11. Disclaimer of Warranties
THE WEBSITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
Some states do not allow the exclusion of certain implied warranties, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable rights you have under applicable consumer protection law.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MOLLYGRACE BOUTIQUE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, WARRANTY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE ORDER GIVING RISE TO THE CLAIM.
Some states do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless MollyGrace Boutique and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the website, or your violation of any law or the rights of a third party.
14. Dispute Resolution and Binding Arbitration
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting arbitration, you agree to contact us at info@mollygraceboutique.com describing your dispute and the relief you seek. We will attempt in good faith to resolve it within 60 days. Most issues are resolved at this stage.
Agreement to arbitrate. If we cannot resolve the dispute informally, you and MollyGrace Boutique agree that any dispute arising out of or relating to these Terms, the website, or any product will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.
Class action waiver. YOU AND MOLLYGRACE BOUTIQUE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.
Costs. Where required by the AAA Consumer Arbitration Rules, we will pay the arbitration filing and administrative fees.
Severability. If the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court and the remainder of this section will continue to apply.
15. Your Right to Opt Out of Arbitration
You may opt out of the arbitration agreement in Section 14 by emailing info@mollygraceboutique.com with the subject line "Arbitration Opt-Out" within 30 days of your first purchase. Include your name and order number. Opting out will not affect any other part of these Terms and will not affect your relationship with us in any way.
16. Governing Law and Venue
These Terms and any dispute arising from them are governed by the laws of the State of [INSERT STATE], without regard to its conflict of law rules. Where a claim is not subject to arbitration, you and MollyGrace Boutique consent to the exclusive jurisdiction of the state and federal courts located in [INSERT STATE].

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, labor disputes, carrier failures, customs actions, changes in trade regulation, and interruptions to internet or payment infrastructure.
Entire agreement. These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and MollyGrace Boutique regarding your use of the website and your purchases, and supersede all prior agreements and understandings.
